Terms of Service

Agreement to Terms

By accessing or using Sondaggio (sondagg.io), you agree to be bound by these Terms of Service and our Privacy Policy. Sondaggio is operated by Telio, LLC. If you're using Sondaggio on behalf of an organization, you represent that you have authority to bind that organization to these terms.

The Service

Sondaggio provides software tools that allow medical and aesthetic practices ("Operators") to send SMS-based satisfaction surveys to patients via unique short codes. The platform includes an operator dashboard, survey builder, analytics, and reporting tools.

Accounts and eligibility

  • You must be 18 years or older to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity under your account.
  • You must provide accurate information when creating an account.
  • One account per practice location on Starter; multi-location accounts available on Growth and above.

Acceptable use

You agree not to use Sondaggio to:

  • Send unsolicited messages (spam) to individuals who haven't interacted with your practice
  • Collect, store, or transmit Protected Health Information (PHI) through survey responses
  • Harvest or scrape data from the platform
  • Reverse engineer or attempt to extract source code
  • Impersonate another practice, person, or entity
  • Violate any applicable law, including TCPA, CAN-SPAM, and applicable state regulations regarding patient communications

Operators are responsible for ensuring that SMS survey delivery complies with applicable telecommunications law in their jurisdiction, including obtaining any necessary patient consent for text message communications.

Payment and billing

  • Paid plans are billed monthly (or annually, if you elect annual billing).
  • You authorize us to charge your payment method on a recurring basis.
  • All fees are in USD and are non-refundable except as described in our refund policy (see Pricing FAQ).
  • We may change pricing with 30 days' notice to account holders.
  • Failure to pay may result in suspension or termination of your account.

SMS and Twilio compliance

Sondaggio uses Twilio to deliver SMS messages. By using the platform, you agree to comply with Twilio's Acceptable Use Policy and all applicable carrier guidelines. You are the Operator of record for your provisioned number. We provision and manage that number on your behalf, but compliance obligations for outbound communications rest with you as the practice.

Intellectual property

Sondaggio and all related software, design, and content are owned by Telio, LLC. Your survey data and responses belong to you — we hold them on your behalf and give you export rights at any time. Nothing in these terms transfers ownership of the platform to you, and nothing transfers ownership of your data to us.

Disclaimer of warranties

Sondaggio is provided "as is." We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or uninterrupted availability. We don't guarantee that the service will be error-free or that all survey responses will be delivered.

Limitation of liability

To the extent permitted by law, Telio, LLC's total liability to you for any claim arising from use of Sondaggio shall not exceed the fees you paid to us in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

Termination

You may cancel your account at any time from your account settings. We may suspend or terminate accounts that violate these terms, after notice where practicable. On termination, your data is available for export for 30 days.

Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Philadelphia County, Pennsylvania, or by binding arbitration if mutually agreed.

Changes to these terms

We may update these terms. Material changes will be communicated via email to account holders at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
